These Terms are an agreement between you and John Abish, the publisher of Fit Assist ("we", "us"). By creating an account or using the app you accept them. You must be at least 18 years old and legally able to enter this agreement. One account per person; accounts are personal and may not be shared.
Fit Assist is a general fitness and nutrition information tool. It generates rules-based meal and workout plans from the information you provide and adapts them to the weights and activities you log. It can also estimate body measurements from two photos of you (the body scan), let you choose a target body shape to plan towards, and draft a food-log entry from a meal photo, a typed description, or a product barcode. Section 5 explains what those estimates are and are not.
Fit Assist is not a medical device and does not diagnose, treat, cure, or prevent any disease or medical condition, and it does not provide medical advice. Nothing in the app — including any body measurement, body-fat estimate, or nutrition estimate — is a diagnosis, a treatment, or a substitute for professional medical care, and using it creates no doctor–patient relationship. We make no medical claims.
Consult a physician before starting any diet or exercise program, especially if you have — or suspect you have — any medical condition, injury, or pregnancy. Stop exercising and seek medical care immediately if you feel pain, dizziness, shortness of breath, or otherwise unwell.
Fit Assist applies safety limits: screening questions at setup, minimum calorie floors, a cap on weight-loss rate, and exits for situations the app is not designed for. These are safety limits, not medical supervision — they cannot account for everything about your health. You agree to answer setup and screening questions truthfully; entering false information to get past a safety gate voids the safety assumptions your plan is built on, and you accept the resulting risk. During setup you accepted our Health Disclaimer; it forms part of these Terms and you can re-read it any time in Settings → Health disclaimer.
The body scan and the meal scan produce estimates generated by software. The body scan is in beta calibration. In particular:
How photos are handled — analyzed and immediately discarded, never stored on our servers — is set out in the Privacy Policy. We make no warranty as to the accuracy of any estimate (section 10).
Keep your sign-in credentials secure; you are responsible for activity under your account. Keep your information accurate — your measurements and health answers are safety inputs, not formalities (see section 4).
Fit Assist has a free tier and a paid Premium subscription: USD $12.99/month or USD $69.99/year (local pricing is shown in the app and set by the store). Premium auto-renews until cancelled. Billing is handled by Google Play: manage or cancel in the Play Store's Subscriptions section — deleting the app or your account does not cancel a subscription. Refunds are governed by Google Play's refund policy, not by us. We will give notice before any price change takes effect at your next renewal. If Premium lapses, your data remains but premium features (including the rolling plan window, weekly adaptation, and the full scan history) are no longer available.
You agree not to: scrape or access the service by automation; reverse-engineer or probe it; resell, republish, export, or redistribute generated plans or the underlying databases; circumvent entitlement, scan-allowance, or content-window restrictions; upload photos of any person other than yourself, or of anyone under 18; or share your account.
We own the app, its plan-generation engine, its measurement model, its meal and exercise databases, and the generated plan content. You receive a personal, non-exclusive, non-transferable, revocable licence to use your plans and scan results for your own fitness. Plans may not be exported, printed for redistribution, or shared commercially. The data you log stays yours, and your photos remain yours: you grant us a licence to process a photo solely to provide the scan you requested, and that processing ends when the analysis finishes. See the Privacy Policy for how to get a copy of your data or delete it.
Fit Assist is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and the accuracy of any measurement, body-composition, or nutrition estimate. Physical exercise and dietary change carry inherent risk of injury; you voluntarily assume that risk. To the maximum extent permitted by law, our total liability for all claims arising from the service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim and (b) CAD $50. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including your statutory rights under Ontario's Consumer Protection Act, 2002 or equivalent consumer law where you live.
You will indemnify us against third-party claims arising from your breach of these Terms or your misuse of the service, to the extent permitted by applicable law.
Sign-in (Clerk, and optionally Google), subscription management (RevenueCat), billing (Google Play), Health Connect, meal-photo analysis (Anthropic), the Open Food Facts product database (used under the Open Database License), and server error monitoring (Sentry) are provided by third parties under their own terms and privacy policies. Body-scan photos are analyzed by our own software on our own server and are not sent to any third-party AI service. If you obtained the app through Apple's App Store, Apple is a third-party beneficiary of these Terms and may enforce them; Apple has no obligation to furnish support or maintenance for the app.
You may stop using Fit Assist and delete your account at any time (in the app: your profile → Account → Delete account, or via the deletion page). We may suspend or terminate accounts that breach these Terms. Any active subscription is governed by Google Play's cancellation and refund rules.
We may update these Terms; the version date above changes and the app gives notice. Material changes will ask for your acceptance again. Continued use after notice of non-material changes constitutes acceptance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Courts located in Ontario have jurisdiction over disputes, except where the consumer law of your place of residence gives you the right to bring proceedings there.
